Land Use

Land use law is one of the most dynamic aspects of property law because it is a union between long standing property law concepts and ever-changing public law and public policy considerations. Local governments rightly consider the emerging needs of communities when changing and evaluating land use policies and zoning laws, but these policies must be balanced with a property owner’s right to develop the highest and best use of their land.

Monaghan lawyers have represented property owners and governmental agencies in condemnation matters as well as issues relating to land use, including zoning issues, planning commission review, permitting, and litigation if it arises. We have represented clients in both state and federal courts, as in administrative proceedings before zoning boards of appeal, and city councils. In addition to zoning laws, our attorneys are attentive to the planning aspect of land use and property development, meeting city and township master plans, resolving environmental problems, and ad valorem taxation.
