Construction Law
Construction law matters can be complicated and involve detailed terms and specifications that govern construction cases. Many contracts may be involved, so a knowledgeable lawyer who has an extensive understanding of construction laws and contracts can be an asset to your construction project or construction case.
Contract Negotiation
At Monaghan P.C., we have experience with AIA agreements and negotiating contract terms and general conditions. We stand up for the rights of our clients whether in negotiating terms for the construction contract with the builder or the builder negotiating with the owner and its counsel. We believe the goal is to have a successful project that gets completed on time and on budget. Avoiding contractual disputes is the metric of our services.
Construction Disputes
When construction disputes arise, we can handle all types of construction law matters for clients in the Detroit Metropolitan area, including Bloomfield Hills, and throughout the state of Michigan. Issues that we can handle include:
- Claims against contractors
- Claims against architects
- Sureties
- Performance and payment bonds
- Construction defects
- Retainage disputes
Michigan Construction Lien Act
Our firm has a wealth of experience handling construction law cases involving the Michigan Construction Lien Act. This act establishes and protects the rights of persons performing labor or providing material or equipment for the improvement of real property to enforce by lien. This allows contractors, subcontractors, suppliers and laborers to place a lien on a property in order to protect themselves from debt and losses. We have handled cases on both sides of this issue, for owners who have had liens placed against their properties and construction parties who have placed liens.
